CTV Reported this morning that the inevitable has happened. The Arar case has moved from the incident to the impact phase. The supreme court of Canada has determined that The United States is not a safe country for refugees, and Canada will no longer have the right to turn back asylum seekers at the border. Thus the court found that the Safe Third Country Agreement STCA breaches the rights of asylum seekers under the United Nation Refugee Convention or the Convention Against Torture.
The agreement denies refugees arriving in Canada via the U.S. asylum in Canada. Presently Canada automatically sends refugees back to the United States. Justice Michael Phelan says the U.S. has not been compliant with the Refugee Convention or CAT (Convention Against Torture). and therefore “… The United States’ policies and practices do not meet the conditions set down for authorizing Canada to enter into a STCA,”
